PLEASE NOTE OF TERMS AND CONDITIONS:

1. ACCEPTING THESE TERMS

This document, our rules, policies and the other documents referenced make up our Terms and Conditions (“Terms”). The Terms are a legally binding contract between you and R.E. Photography. Please read them carefully.

2. CHANGES

R.E. Photography may amend the Terms at any time by posting a revised version on our site. The revised version will be effective at the time we post it.

3. ACCESS

You are granted a non-exclusive, limited and revocable license to access the site and use its functionality on the condition that:

(a) You are over the age of 18;

(b) You only use the site for lawful purposes;

(c) You do not engage in any improper, indecent or offensive behavior while using the site; and

(d) You are not breaking any law in your relevant jurisdiction by accessing this site.

4. GOVERNING LAW

This terms and conditions shall be construed in accordance with the laws of the state of Ohio, without reference to its conflict of law provisions and the obligations, rights and remedies of the parties hereunder shall be determined in accordance with such laws.

5. TERMS

Both parties herein agree to above detailed package details .

R.E. Photography offers both studio and outdoor on location pricing is available. In addition to that, USB and/or CD with print releases are available for purchase with this package. R.E. Photography also offers printing upon the client receiving his or her gallery.

Client understands that the packages offered by R.E. Photography are non-refundable after purchase.

Galleries are downloadable in web and mobile formats. Prints can only be made via R.E. Photography online galleries upon receiving your proofs to ensure you get the best quality and color corrections. You can however, purchase a digital print release, as well as the images in full resolution or on a USB ($50), if needed, after confirmation of image selections.

6. INDEMNITY

You agree that you will be responsible for your use of the website, and you agree to defend and indemnify R.E. Photography from and against every claim, liability, damage, loss, and expense, including reasonable attorneys’ fees and costs, arising out of or in any way connected with: (i) your access to, use of, or alleged use of, the app/site; (ii) your violation of any portion of this terms and conditions, any representation, warranty, or agreement referenced in these terms, or any applicable law or regulation; (iii) your violation of any third party right, including any intellectual property right or publicity, confidentiality, other property, or privacy right; or (iv) any dispute or issue between you and any third party.

7. LIMITATION OF LIABILITY

In no event will R.E. Photography be liable to you for any indirect, incidental, special, consequential or punitive damages (including damages for loss of profits, goodwill, or any other intangible loss) arising out of or relating to your access to or use of, or your inability to access or use, the website or any services available through the website, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not R.E. Photography has been informed of the possibility of damage.

8. PERSONAL ACCIDENT

Any directions issued to clients or their guests during a photographic shoot are deemed to be at said persons own risk. R.E. Photography cannot be held responsible for any personal accidents during a photographic shoot.

9. FORCE MAJEURE

Photographers are not to be held accountable for: Weather conditions, or props malfunctions due to weather related occurrences such as wind, etc. Clothing Malfunctions or stains which are unable to be edited. Cooperation of subject(s). (ex. Smiling, attentiveness, etc.).

10. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

10.1 R.E. Photography does not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

10.2 R.E. Photography does not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

11. NO SHOW/LATENESS

There is a 10 minute no show/lateness policy. After 10 minutes, session is forfeit and any moneys paid is nonrefundable. If a reschedule is needed, a $25 rescheduling fee may be charged.
